Supreme Court Rules Against EPA in Emission Regulations

(WASHINGTON, DC) - It's a ruling that is too late for some power plants, but the US Supreme Court ruled yesterday that the EPA overstepped its bounds in implementing regulations to limit emissions from power plants.

The court did not necessarily rule the regulations were unreasonable. However, in a 5 - 4 decision, did say the EPA needed to consider the cost of implementation when deciding to make the regulations -- not when the new rules are written.

The court decision was applauded by Republican Sixth District Congressman Bill Johnson and Democratic Senator Joe Manchin.

Johnson says there must be a balance between health regulation and costs that would have a chilling impact on jobs and the cost of electricity.

Manchin says the ruling sends a strong signal to the EPA that it must stop ignoring economic damage regulations are causing to the energy sector and the economy.

Both men say the EPA continues to impose regulations regardless of the economic impact they may have -- a practice they say must stop.
