Earlier this year, Ketelsen was charged with felony charges of theft concerning missing painkiller medications that disappeared from the jail in 2010.

Ketelsen maintained his innocence and following a bench trial, was acquitted.

In September he filed a lawsuit for damages against Sheriff Mincks for his statements to the media made before and during the trial.

Mincks responded earlier this month with a motion to dismiss. According to the Sheriff’s Office, Ketelsen filed a voluntary motion to dismiss on Tuesday.
